Terms of Use for Taif - AI Tools

Please read these Terms of Use carefully before using the Taif - AI Tools mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms of Use. If you do not agree to all of these Terms, do not use the App.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and J.M.J Offshore S.A.L ("we," "us," or "our") regarding your use of the App. By accessing or using any part of the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Taif - AI Tools is a mobile application that provides users with access to various artificial intelligence tools and features. These tools may include, but are not limited to, text generation, information retrieval, language translation, and other AI-powered functionalities. The App is designed to assist users with various tasks by leveraging AI technology.

3. User Conduct

By using the App, you agree to the following:

• Lawful Use: You will use the App only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
• Respectful Interaction: You will interact with the App and its AI tools in a respectful and appropriate manner. You will not use the App to generate or disseminate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, ethnically, or otherwise objectionable.
• No Harmful Content: You will not use the App to generate or disseminate viruses, malware, or any other harmful code or content that could damage, disable, overburden, or impair the App or our systems.
• No Spam or Unauthorized Communications: You will not use the App to send spam, unsolicited messages, or other unauthorized communications.
• No Circumventing Security: You will not attempt to circumvent or disable any security features or measures of the App.
• No Data Mining or Scraping: You will not use any automated means, including robots, spiders, or scrapers, to access, collect, or extract data from the App without our express written permission.
• Responsibility for Input: You are solely responsible for the accuracy, quality, and legality of any input or content you provide to the App.
• Appropriate Use of Output: You understand that the output generated by the AI tools is based on complex algorithms and may sometimes be inaccurate, incomplete, or biased. You are responsible for evaluating the accuracy and appropriateness of the output before relying on it. You should not use the App for critical decision-making without independent verification.

4. Intellectual Property

• Our Ownership: The App, including its design, code, graphics, and all other content provided by us, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only, in accordance with these Terms.
• User-Generated Content: You retain ownership of the content you input into the App. However, by using the App, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your input for the purposes of providing, improving, and developing the App and our services.
• Feedback: If you provide us with any feedback, suggestions, or ideas about the App, you agree that we are free to use such feedback without any obligation to you.
• Trademarks: "Taif - AI Tools" and our logos are our trademarks. You may not use our trademarks without our prior written permission.

5. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR OUTPUT GENERATED BY THE APP. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO US FOR THE USE OF THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE UNITED STATES DOLLAR (USD $1.00) IF NO SUCH PAYMENT WAS MADE.

THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY EVEN IF THE REMEDY PROVIDED HEREIN FAILS OF ITS ESSENTIAL PURPOSE.

7. Indemnification

You agree to indemnify, defend, and hold J.M.J Offshore S.A.L and its affiliates, officers, directors, employees, agents, and licensors harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights; or (d) any content you input into the App.

8. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and without prior notice or liability. Reasons for termination may include, but are not limited to, your breach of these Terms, your engagement in prohibited conduct, or our decision to discontinue or modify the App.

You may also terminate your use of the App at any time by ceasing to access it.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Lebanon. You agree that any legal action or proceeding between you and us for any purpose concerning these Terms or your use of the App shall be brought exclusively in the courts located in Lebanon.

10. Changes to These Terms

We may modify these Terms of Use at any time by posting the updated terms within the App or on our website. We may also provide you with notice of significant changes through other means, such as by email. Your continued use of the App after the posting of any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically for any changes.

12. Entire Agreement

These Terms of Use constitute the entire agreement between you and J.M.J Offshore S.A.L regarding your use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
